I am not a lawyer, but this law treats virginia rersidents different than an out of state resident. The penalties $ are extremely high, they do not seem to fit the "crime". This seems to be taxation without representation, and a bonanza for lawyers. If I was a lawyer in that line of bussiness I would be extremely happy. My business just tripled overnight.
On top of everything throw in a higher insurance bill.
They do not allow radar detectors. I would risk the radardetector fine rather than one for speeding.
I am glad I do not live there.

One more example of abuse of power by elected officials. My dad always told me that people become politicians because they cannot hold a real job. As usual, he was correct!
My initial impression is that it won't hold up in court, because A) it's being applied in a discriminatory manner: only on VA residents; and B) it's punitive in application, and thus represents an additional punishment beyond the original fine and/or jail time.
However, from what I've been reading, it sounds like the state courts are in collusion with this, so the odds of overturning it are very slim (at least, not without going to Federal court, and the cost of that is probably much higher than just paying the fine).
In the past I have warned VA drivers to be careful and not use a radardetector in the state because they have radardetector detectors. But I'd much rather have one of those tickets than a $3,000+ speeding ticket.

More BS from the state of Va. to raise money. I live here too. I'm not a lawyer but I don't see how this can hold up in court for resident vs non-resident. I'm not a big fan of the ACLU but this is right up their alley! Any ACLU lawyers in the club?
I'm no expert, however this is not really a fine, as I understand it. It is sort of a surcharge (to make $) on top of the normal fines.
It is administered by the Virginia DMV, rather than the courts, and they can cancel the license of the offender who does not pay. Since they cannot do this to drivers who are licensed in other states, it applies only to Virginians.
Sure to be challenged, but I percieve some lower speeds on I-81 since July 1.

Remember to add the worth of your detector on top of the fine itself... they confiscate your detector and destroy it when they catch you with one of them.

From what I understand, there is talk of repealing the fines in January. Hopefully, they'll be gone if people raise enough stink. Lawmakers like the one who introduced these fines (a traffic attorney from Northern Virginia...hmmmmm) love the fact that the general public is fairly ignorant of what is going on and doesn't complain until it's too late.
